Notary Public

A notary public (also known as a public notary or notary) is a solicitor or barrister who is given statutory powers at a national and international level. The predominant reason you may require a public notary is that you need certified or attested documents for use in overseas countries.

Our principal, Igor Kazagrandi, is an appointed public notary in NSW and offers a complete range of notarial services to companies, small businesses, government bodies, individuals, and other law firms. We can assist you with:

What is a Public Notary?

Public notaries in New South Wales are governed by the Public Notaries Act and the Public Notaries Appointment Rules. Public notaries must hold a current Australian practising certificate, have been a barrister or solicitor for a continuous period of five years and have completed a Notarial Practice Course conducted or approved by the Legal Profession Admission Board of NSW.

Notary publics are issued with an official seal or stamp which is registered along with their signatures and stored in a database held by the Department of Foreign Affairs and Trade. The seal/stamp and signature are recognised in Australian and International Courts and placed alongside or underneath a notary’s signature when carrying out notarial services.

 

When Might I Need the Services of a Notary?

The services of a notary may be required for a range of commercial transactions such as overseas trade documents (letters of credit), contractual arrangements between foreign businesses (transfers of foreign assets, property, and land) and matters concerning international trademarks, copyright, or patent applications.

At a personal level, you may need to have documents notarised if they are to be used overseas or have been issued from another country. Notary services may include the certification of passports, academic transcripts, citizenship certificates and consent to travel documentation, probate documents where overseas assets form part of an estate, and overseas police checks.

 

Your Appointment with a Notary Public

When performing their duties, notaries must confirm the identity of the person signing a document or swearing an oath. If you are acting in an official capacity, for example, as a director of a registered company or under a power of attorney, you must provide documentation showing that you have the relevant capacity and authority. Some documents that are not in English may need to be translated before they can be processed by a notary.
